Agreement to Terms

By creating an account or using CrypticAgent you agree to be bound by these Terms. If you do not agree you must not use the service. CrypticAgent reserves the right to update these terms at any time with 30 days notice via email.

Description of Service

CrypticAgent is a cybersecurity SaaS platform providing AI agent monitoring, non-human identity governance, compliance automation, and AI workflow automation. The service is provided on a subscription basis. Features and functionality may change over time with reasonable notice.

Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old to create an account.
• One person or legal entity may not maintain more than one free account.
• You are responsible for all activity that occurs under your account.

Subscription and Billing

• Subscriptions are billed in advance on a monthly or annual basis.
• All payments are processed securely through Stripe.
• Prices are listed in USD and subject to change with 30 days notice.
• Annual subscriptions are billed in full at the start of the subscription period.
• Monthly subscriptions renew automatically unless cancelled.
• You can cancel your subscription at any time from the billing page.
• No refunds are provided for partial months or unused annual subscription periods except where required by law.
• CrypticAgent reserves the right to suspend accounts with failed payments after 7 days notice.

Free Trial and Free Scan

• The free security scan is provided at no cost and requires no payment method.
• Free trial periods, if offered, are for new customers only.
• CrypticAgent reserves the right to modify or discontinue free offerings at any time.

Acceptable Use Policy

You agree NOT to:

• Use CrypticAgent for any illegal purpose or in violation of any laws.
• Attempt to gain unauthorized access to any systems or networks.
• Use the service to store or transmit malicious code.
• Reverse engineer, decompile, or disassemble any part of the service.
• Resell or redistribute the service without written permission except through the MSP program.
• Use automated tools to scrape or extract data from the platform.
• Interfere with or disrupt the integrity or performance of the service.
• Create false or misleading accounts or impersonate any person or entity.
• Use the service in any way that could damage the reputation of CrypticAgent.

Intellectual Property

• CrypticAgent and all its content, features, and functionality are owned by CrypticAgent LLC and protected by US and international copyright and trademark laws.
• You retain ownership of your own data uploaded to the platform.
• CrypticAgent is granted a limited license to process your data solely to provide the service.
• The CrypticAgent name, logo, and brand are trademarks of CrypticAgent LLC.

Data and Security

• CrypticAgent implements industry standard security measures to protect user data.
• You are responsible for the security of the credentials and integrations you connect to the platform.
• CrypticAgent will notify you of any confirmed data breaches affecting your account within 72 hours of discovery.
• CrypticAgent does not store actual credential values. only metadata about credentials.
• You can export or delete your data at any time from the settings page.

No Warranty and As-Is Service

CrypticAgent is provided on an as-is and as-available basis without warranties of any kind, either express or implied. CrypticAgent LLC makes no warranties regarding the accuracy, reliability, completeness, or timeliness of the Service or that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

You acknowledge and agree that your use of the Service is at your sole risk. CrypticAgent LLC does not warrant that the Service will detect all security threats, identify all non-human identities, discover all AI agents, prevent all breaches, or meet your specific security requirements. No security product can guarantee complete protection from all threats.

Limitation of Liability

To the maximum extent permitted by applicable law, CrypticAgent LLC and its officers, directors, employees, contractors, affiliates, licensors, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, business interruption, or other intangible losses arising out of or related to your use or inability to use the Service, even if CrypticAgent LLC has been advised of the possibility of such damages.

In no event shall CrypticAgent LLC's total cumulative liability to you for all claims arising out of or related to the Service exceed the amount you have paid to CrypticAgent LLC in the twelve months immediately preceding the event giving rise to the claim, or one hundred dollars, whichever is greater.

No Professional Advice

CrypticAgent is a software tool, not a professional service. The Service and any content, recommendations, analyses, risk scores, or suggestions generated by the Service, including those generated by the AI Security Assistant, are for informational purposes only and do not constitute professional cybersecurity consulting, legal advice, compliance certification, financial advice, or any other form of professional services. For licensed professional services, engage qualified third-party professionals.

You should not rely solely on the Service for any critical security decisions. For professional cybersecurity consulting, legal compliance advice, audit certification, or regulated compliance activities, you should engage qualified licensed professionals. CrypticAgent LLC and its representatives are not licensed cybersecurity consultants, attorneys, certified public accountants, or compliance auditors unless otherwise explicitly stated and documented.

User Responsibility for Security

You are solely responsible for the security of your own systems, data, credentials, and environments. CrypticAgent is a monitoring and governance tool that provides visibility and recommendations. Implementation of security measures, remediation of identified risks, and overall security posture remain your responsibility.

CrypticAgent LLC is not responsible for any security breach, data loss, unauthorized access, or compromise of your systems that occurs while you are using the Service. This includes but is not limited to breaches that occur because you did not act on recommendations, breaches caused by misconfigurations not detected by the Service, zero-day vulnerabilities, insider threats, or any breach regardless of cause.

No Guarantee of Specific Outcomes

CrypticAgent makes no guarantees about specific outcomes from using the Service. This includes but is not limited to guarantees of achieving compliance certification, passing audits, preventing breaches, reducing security costs, or any other specific business outcome. Individual results depend on many factors outside of CrypticAgent's control including your implementation, environment, and ongoing security practices.

Third Party Integrations

The Service integrates with third party services and platforms. CrypticAgent LLC is not responsible for the availability, accuracy, security, or terms of service of any third party service. Issues with third party integrations, including service outages, API changes, data breaches at the third party, or changes in functionality are not the responsibility of CrypticAgent LLC.

Indemnification

You agree to indemnify, defend, and hold harmless CrypticAgent LLC, its officers, directors, employees, contractors, affiliates, licensors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Service, your violation of these Terms, your violation of any third party rights, or any content you submit through the Service.

Marketing Claims and Forward-Looking Statements

Any marketing materials, landing page content, case studies, testimonials, or statements about CrypticAgent's capabilities, pricing comparisons, or expected outcomes are general descriptions and may not apply to every customer situation. Individual results vary based on the customer's environment, implementation, and ongoing practices. Pricing comparisons to other services are approximate and reflect publicly available information at the time of publication.

References to comparative pricing such as industry average breach costs or comparisons to other services are general informational statements and do not represent guarantees about specific customer outcomes or savings.

Summary of Liability

• CrypticAgent is a security monitoring tool. we help identify and alert on security risks but cannot guarantee prevention of all security incidents.
• Users remain responsible for implementing the remediation actions recommended by CrypticAgent.

Third Party Services

• CrypticAgent integrates with third party services including AWS, Google Cloud, GitHub, HubSpot, Stripe, Salesforce, Slack, Microsoft Azure, Okta, and Zapier.
• CrypticAgent is not responsible for the practices or content of third party services.
• You must comply with the terms of service of all connected third party platforms.

MSP and White Label Terms

• MSP partners may resell CrypticAgent services to their clients under their own branding.
• MSP partners are responsible for ensuring their clients comply with these terms.
• MSP partners may not represent themselves as CrypticAgent or claim ownership of the platform.
• MSP agreements require a separate written agreement with CrypticAgent LLC.

Termination

• CrypticAgent may terminate or suspend any account immediately for violation of these terms.
• You may terminate your account at any time from the settings page.
• Upon termination user data will be deleted within 30 days unless required by law to retain it.
• Termination does not relieve you of any payment obligations already incurred.

Governing Law and Disputes

• These terms are governed by the laws of the State of Georgia, United States.
• Any disputes shall be resolved through binding arbitration in Georgia.
• You waive your right to participate in class action lawsuits against CrypticAgent.
• Small claims court actions are excluded from the arbitration requirement.

International Users

• CrypticAgent is operated from the United States.
• International users access the service at their own risk and are responsible for compliance with local laws.
• For European users CrypticAgent complies with GDPR requirements as detailed in the Privacy Policy.

Changes to Terms

• CrypticAgent reserves the right to modify these terms at any time.
• You will be notified of material changes via email 30 days in advance.
• Continued use of the service after changes constitutes acceptance of the new terms.
